Probable Cause On 07-15-2021, at 0135 hours, Brainerd officers were advised of a 911 hang-up call in the area of the 307 North 8th Street, Brainerd, Crow Wing County. Crow Wing County Dispatch stated that there was a 46-meter radius, and when they called back, a female voice answered but did not say anything or respond to any of the questions from the dispatcher.Sergeant Rosier was in the area and responded, Sergeant Rosier observed lights on at 307 North 8th Street, which is a two-apartment residence. Rosier made contact in the front apartment of the building and met with the two residents, who indicated they had not called 911. Thereafter, Rosier proceeded to the back apartment, which is apartment 2. Through previous law enforcement contact, Rosier is familiar with the tenants of that apartment to be Kip Lamarr Bohlke, dob/102391, as well as S.M.K.. Sergeant Rosier, made contact with Bohlke and asked where S.M.K. was at. Bohlke stated she was in the bedroom in the northeast portion of the residence. Bohlke was directed to stand in the doorway with Officer Engst and Officer Gleason at this time. As Rosier came into the living room, a male party, identified as Tyler John Cuffe, was identified and found to be standing in living room. Rosier directed Cuffe to stand over by officers at this time.Rosier proceeded to the bedroom with the lights on in the northeast corner of the residence where a female party was observed hunched over in a fetal-like position, crying on a bed that appeared to be unkempt and sheets pulled off of the mattress. Rosier identified this female party as S.M.K.. S.M.K. had her head in her hands, shielding her face away from Rosier. Rosier asked S.M.K. what took place, and S.M.K. stated that she had contacted the police department by calling 911.Rosier asked why S.M.K. had felt she needed to contact law enforcement. She stated that they had been arguing. Rosier asked S.M.K. who she was referring to when she stated that they had been arguing. She stated she had been arguing with Bohlke. Rosier proceeded to ask S.M.K. what took place.Rosier learned that S.M.K. and Bohlke had been lying on the bed in the bedroom. S.M.K. was on the side of the bed closest to the door and Bohlke was behind her. Rosier was advised that Bohlke was pestering S.M.K. into having sex. S.M.K. stated that she did not want to have sex at that time with Bohlke. S.M.K. confirmed that Bohlke is her significant other, and they share one child in common.The childwas not at the residence at this time. When S.M.K. told Bohlke she did not want to have sex, he wrapped both of his arms around her neck and began to squeeze. S.M.K. indicated that both arms were wrapped around both sides of her neck which would have been covering her carotid arteries. S.M.K. stated that Bohlke began to squeeze and apply pressure on her neck, which caused it to hurt and caused her to have restricted breathing. When she stated that she could not breathe and was telling him to stop, he continued to press and compress harder on her neck, causing her almost to lose consciousness.S.M.K. stated that she was fearful of Bohlke and scared that if he would not stop she did not know what would take place and he would continue to choke her until she lost consciousness. S.M.K. stated that Bohlke was shouting and swearing at her to the point where she believed if she did not get away he would hurt her more. S.M.K. was finally able to pull away from Bohlke, to which she stood up and walked away to the northern side of the room where she was attempting to get dressed. At that point at
S.M.K. was facing westbound towards a dresser that was in the northwest corner of the room when Bohlke got out of bed and pushed her into the wall. Bohlke used both hands to push S.M.K. into the wall, which her right side collided into the wall and caused her pain.S.M.K. stated she also has a previous injury to her right side of her ribs from Bohlke approximately two days ago when he kicked her in the ribs and they were quite possibly bruised or swollen. S.M.K. stated that as Bohlke pushed her into the wall he hit her in the back with a close-handed fist. S.M.K. stated that the fist landed in her midsection of her back, right on the spine, which caused her pain and hurt bad whenever she tried to move. S.M.K. stated that as she got hit in the spine she felt down to the ground and eventually ended up sitting with her back against that northern wall. Bohlke continued to yell, scream, and shout, calling her a worthless wife and other profanities. Bohlke then hit S.M.K. on the left side of the face with a close-handed fist. S.M.K. stated that this injury was sore to the touch and it hurt.Rosier did not observe any visible bruises at this time. Bohlke eventually left the room to go outside, possibly to smoke. This is when S.M.K. eventually left the room with her cellphone and called 911. S.M.K. informed Sergeant Rosier that she is very scared and fearful of Bohlke, as when he is mad, he tends to lose his temper.Rosier spoke further with S.M.K. about the incident that took place. S.M.K. informed Rosier that a previous incident had taken place approximately two days prior, on 07/13/2021. S.M.K. informed Rosier that Bohlke and her got into a physical altercation to which Bohlke struck her several times, pushed her down to the ground, kicked her in the ribs, punched her in the abdomen, as well as hit her ears. Rosier noted that when S.M.K. was describing that altercation that there was visible bruising on her ears as well as her arms and on her back and abdomen area. As Rosier was speaking with S.M.K., he noted on S.M.K.’s left eye to be a blood mark. S.M.K. stated that this mark was from Tuesday, 07/13/2021, and was not from tonight.Photographs were taken of S.M.K.. Rosier took photographs of her neck area as well as face.Rosier noted S.M.K.’s face to be somewhat red and swollen with a visible mark on her left eye as well as visible bruises on S.M.K.’s left tricep/bicep. While speaking with S.M.K., she complained of rib and abdomen pain from the previous injuries as well as pain due to the bruising. S.M.K. denied medical attention on several occasions when asked by Sergeant Rosier but eventually agreed to be transported to the emergency room by Sergeant Rosier. Medical records indicate S.M.K. suffered a transverse process fracture of lumbar vertebra, which is the low back area where Bohlke punched/kicked S.M.K. on July 13, 2021.Bohlke has at least five prior qualified domestic violence related convictions within the past 10 years, including an August 18, 2017 conviction for Assault Third Degree in file 18-CR-16-2681 and a July 27, 2017 conviction for Stalking-Pattern of Stalking in file 18-CR-17-1689.
